Terms and Conditions

§ 1 Scope and subject matter

These terms govern all memberships (subscriptions) purchased via kicksdepartment.com / kicksdepartment.de granting access to paid areas of the “Kicks Department” Discord server. The contract is concluded upon completion of the checkout process via the payment provider Stripe.

§ 2 Services

Depending on the booked tier (Basic, Premium, Enterprise), the Provider grants access to specific channels of the Discord server by automatically assigning a Discord role once payment or the trial begins. Higher tiers include the services of lower tiers. A Discord account and server membership are required; Discord is a service of Discord Inc., whose availability is outside the Provider's control.

§ 3 Trial, term and cancellation

All tiers start with a 14-day free trial. Thereafter the membership renews automatically for one month or one year depending on the chosen billing period, unless cancelled before the end of the current period. Cancellation is possible at any time effective at the end of the current billing period via the Stripe customer portal (accessible from the dashboard). No charges arise if cancelled during the trial.

§ 4 Prices and payment

The prices displayed at the time of ordering apply (incl. VAT). Payments are processed by Stripe. If a payment fails or the subscription ends, access (the Discord role) is revoked immediately.

§ 5 Tier changes

Switching tiers is possible at any time via the Stripe customer portal. Upgrades are prorated and take effect immediately; downgrades take effect at the start of the next billing period unless stated otherwise in the portal. Discord roles are adjusted automatically.

§ 6 Legit check and middleman service

Legit checks are non-binding assessments based on the information provided (e.g. photos). They constitute neither a guarantee, an expert opinion, nor an assurance of authenticity. The middleman service merely facilitates transactions between buyer and seller; the Provider does not become a party to contracts concluded between members. To the extent permitted by law, the Provider accepts no liability for transactions between members, their execution, or resulting damages.

§ 7 Member obligations

Members undertake to comply with the server rules, not to infringe third-party rights, and not to share their access. In case of serious or repeated violations, the Provider may suspend access; fees already paid will not be refunded where the member is responsible for the violation.

§ 8 Liability

The Provider is liable without limitation for intent and gross negligence and for injury to life, body or health. For slightly negligent breaches of essential contractual obligations, liability is limited to the foreseeable damage typical for this type of contract; otherwise liability is excluded. Liability under the German Product Liability Act remains unaffected.

§ 9 Right of withdrawal

Consumers have a statutory right of withdrawal. Details are set out in the withdrawal policy.

§ 10 Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; for consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of their country of habitual residence. Should individual provisions be invalid, the remainder of the contract remains effective.
